Somerset Highways have communicated the following regarding the damaged walls close the Bowden Road
West Side and Kington View
Further to my points in previous updates, a (SCC) meeting was held on 16th November 2022 to further determine progress and options, the current situation is that SCC legal are now drafting the formal HA1980 S167 notices which will be supported by the options report carried out by SCC. The HA1980 S167 will be served to the legal representatives of the affected land/wall where we know the ownership and to those that may be affected dependent on the Land Registry determination. We will be instructing what action they are required to take and within what timescales. Failure to meet the actions and timescales will result in SCC being able to instruct works and recover full costs from doing so. I expect this HA1980 S167 to be issued by Mid Dec 2022.
As previous, from the prelim survey report, the arrangement of the pole at this location is not deemed suitable so raised with Scottish and Southern Energy to answer, still nothing from them following my previous enquiries.
East Side
I met with the residents on 18th Nov 2022 and the situation was discussed, I am still waiting further information from SCC legal on the matter regarding ownership however an agreement in principle was made where I will request a quote from our contractor for a minor repair to the small section, where some stones have slipped out. This does not form an acceptance that the wall on this side is SCC responsibility, as that is still to be determined, but this is in considering a ‘whole’ solution without further delays and to be able to open the road fully to traffic in conjunction with any works to the West side (as above 23rd Nov).
Clearly there has been some progress made but the barriers and traffic light control will remain for some time.
